Guardianship

    Petitions are accepted from 8:00 to 11:30 and 1:00 to 4:30 daily.

    Our office processes Adult and Minor Guardianship and/or Conservatorship upon the proper completion of the petition.  The Probate clerks are not allowed to assist in the completion of this paperwork and petitioner should always consult with an attorney if he or she has any questions.  Below is some general information about the process and fees involved with these proceedings.

Adult: Petition must be completed in black ink and filed with minimum filing fees of $260.00. Once the petition is filed we will get a court order evaluation scheduled and notify the proposed ward.  Once the evaluation is completed a hearing will be set and all parties will be notified.  The remaining balance of approximately $250.00 will be required at the time of the hearing.  You may contact Melinda at 706-387-6277 if you have questions.

Minor: Petition must be completed in black ink and filed along with a certified copy of the childs birth certificate. Our Judge also requires some additional paper work to be completed and a background check for the proposed guardians.  Both mother and father must be notified of the petition, unless the parental rights have been removed by a higher court.  A copy of the Court Order must be provided. In the case of the death of either parent a certified copy of the death certificate must be provided.  You may contact Jennifer at 706-387-6276 if you have questions.
